REQUESTED ACTION (S)

a)               AGREEMENT - Request approval and authorization for the Executive Director to sign the Acceptance of Allocation Agreement No. CTCP-17-52 with the California Department of Public Health Tobacco Control Program in the amount of $369,105, effective 7/1/17 through 6/30/18

(Miscellaneous Agreement #2017-236)

BACKGROUND INFO

This is phase I of the four phase 2017-2021 Comprehensive Tobacco Control Plan allocation from the State of California for local assistance to fund the Tehama County Health Services Agency's (TCHSA) efforts to control tobacco activities throughout Tehama County. This is a returning allocation in which the State requires the local health jurisdiction to sign an Acceptance of Allocation Agreement each fiscal year.  If this agreement is not signed, TCHSA will lose the ability to provide multi-level community changes for Tehama County residents.  This includes but is not limited to, tobacco education, community prevention activities, outreach to create smoke-free zones and to limit advertising of tobacco products.

It is important to note that this agreement for participation in the Comprehensive Tobacco Control Program does contain the State's standard indemnification language which requires Counties to defend the State in any adverse actions, irrespective of whether or not there is any negligence on the part of the County.
